THE JOB’s terms & conditions of service for business member are subjected to all terms & conditions set forth herein (Terns & Conditions of Services) Terms & Conditions of Use and Privacy Policy. By using or purchase THE JOB‘s services for business member as defined below, you acknowledge that you are aware of all terms & conditions set forth and agree to be bound by these Terms and Conditions of Services. Any new features, upgrades, variations or new packages which are added or modified to the current services shall also be subject to these Terms and Conditions of Services. Unless otherwise stated, if you engage to any other particular services rendered by THE JOB or offered on the Site, you acknowledge that additional terms and conditions of each particular service may apply.

1. THE JOB’s SERVICES FOR BUSINESS

THE JOB allows Business’s job posting to be served on the Site and to widely and nonspecifically target on any Members. After you applied the member package which fit with your needs, The digital recruiting tool are made available and easily accessible in a variety of technology platforms.THE JOB, in its absolute and sole discretion, reserves the right to determine the size, placement and positioning of your postings. You acknowledge that your postings on the Site shall rely on terms & conditions of member package and first come first serve basis and the Site availability.


2. RESPONSIBILITIES

(a) By using or purchasing the Services, you agree that you are responsible for:

  1. all information and content including but not limited to job descriptions, trademarks, logos, images, URLs and any other materials that creates contents or job posting submitted by or on your behalf through theSite, and
  2. any activities conducted through your account with THE JOB, including any purchases made or Fees incurred.

(b) If you identify that you are using the Services on behalf of a business or third party, you agree that THE JOB may share information about your purchases and use of the Services with that business or that third party including its representatives. If THE JOB is informed that you are not authorized, no more authorized, or on behalf of by such business or third party, you agree that THE JOB may eliminate you from the account associated with the business or third party.

(c) Without prior written consent of THE JOB, you shall not sell, resell, lease or transfer access to the Services or relevant data to any other party.


3. TJ WALLET AND COINS

THE JOB make available a coin account balance associated with your account (“TJ Wallet”). The TJ Wallet is neither a bank account, coin is not any kind of payment instrument. Your coin account balance will be shown current coin amount after your actions on buying coin, and be used for purchasing of member package, digital engagement services including any other services or products that TJ Wallet transactions are made available by THE JOB.

You may place funds in your TJ Wallet up to a maximum amount determined by THE JOB by any payment methods determined and accepted by THE JOB.

Any TJ Wallet Coins that are in your coin account ,or you may have and funds added to the TJ Wallet are non-refundable and non-transferable for whatever reasons and must be used prior to expiration or termination of your account follow the Terms and Conditions of Use or Terms and Conditions of Services.

The TJ Wallet Coins do not constitute any personal property rights, have no value outside the Site and can only be used to purchase particular services on the Site. The TJ Wallet Coins have no cash value and are not exchangeable for cash.

You will be notified of any change to TJ Wallet coin balance in your coin account


4. TERMS OF USE

Please check terms & conditions of service of package member you applied. Each package offers unlimited job posting anyway you acknowledge that one posting must be for one job and one position in particular.You also agree that you will not and you will not authorize, enable or support anyone with respect to any posting or use of the Services to:

  • make or publish any posting without real and reasonable intention in relation to employment or job opportunity;
  • make or publish any posting that distorts the job,employer or any other person;
  • make or publish any posting for direct selling opportunities, network marketing, multilevel marketing, person-to-person marketing, one-on-one marketing or any jobs that may require payments, bearing any costs or recruitment of others in relation to employment or that resemble club memberships, distributorships, or are entirely or almost entirely commissionbased;
  • make or publish any posting in Thailand without possessing valid TAX Identification Number (if applicable) or make or publish any posting in any way that may not be in compliance with applicable tax regulations and laws;
  • make or publish any posting which does not clearly disclose that a position in particular is full-time, part-time, temporary contract, commission-based, for short-term project, or has any specific working requirements/conditions or compensation;
  • spam or reach Candidates/People for other purposes which are not relevant to the employment or job opportunity in particular detailed in valid posting;
  • stalk, bother or reach any People after they have asked not to be contacted;
  • make or publish any posting for job that may be in breach of applicable laws, rules or regulations;
  • make or publish any posting by intentional misrepresentation;
  • make or publish any posting, participate in any job, employment, transactions, solicitations or recruitment that may be in violation of employment discrimination, any laws, rules or regulations in Thailand, where the employment will be done and any other states and countries where over;
  • participate or involve in whole or in part in any conduct or business that may be or may lead to fraudulent or illegal;
  • use any means or form of scraping or data extraction to download, access, modify, or otherwise collect data from the Site except as consent by THE JOB in writing;
  • copy, modify, decompile, reverse engineer or create derivative works of the Services, the Site or any related technology except as consent by THE JOB in writing;
  • make or publish any posting which may contain malware, spyware or any other malicious codes or interfere with the operation of the Services or any device or system or violate or circumvent any security measures of THE JOB or any others; and
  • disclose, publish, distribute or use of any data received or published in the Site without authorization of THE JOB or proprietor or may be in violation of Terms and Conditions of Use, the Privacy Policy, Terms and Conditions of Services and any other applicable agreements related thereto.

You acknowledge that THE JOB is not obliged to share or publish any content or data on the Site and may, in its absolute and sole discretion, modify, reject or remove any posting at any time for any reason with or without notice, regardless of whether or not such posting was agreed or served on the Site before.


5. BUYING COINS, FEES, PAYMENT AND CLOSING YOUR ACCOUNT

Buying coins, you shall be responsible for all charges incurred, including all applicable taxes, government charges, transfer fees, foreign exchange fees and all purchases made by you or anyone that uses your account (“Fees”).

You agree to pay at the applicable local currency rate for the time being when you make any purchasing order, or other currency rates purchases submitted through your account (“Rate”).

All buying coins amount and any fees which made by you or anyone that use your account are non-refundable and non-transferable. After payment made, your purchased coins will be put in your coin account (TJ Wallet), the electronic tax invoice and receipt of your payment will be provided through the Site.

All your coins spending to apply for member , pay for services and other services on Site which made by you or anyone that uses your account are non-refundable and non-transferable.

Closing your account, you acknowledge and agree that after your account is closed, coins balance in your account will usually removed from THE JOB services and in condition that all coins balance left on closed date are non-refundable and non-transferable. THE JOB reserves the right to collect Fees, surcharges or costs incurred before closing your account. You remain responsible for any outstanding balances which must be settled before closing your account. Anyway THE JOB is welcome you to do a new register as a new Business member.


6. INTELLECTUAL PROPERTY RIGHTS

You grant to THE JOB a non-exclusive, worldwide, royalty-free, sub-licensable and transferable license to use, copy, modify, process, distribute and publish your content, data and posting in connection with the performance of the Services

including but not limited to marketing and promotional purposes without requiring any further consent, notice or compensation to you or any other persons.You represent and warrant that you own or have all necessary rights including intellectual property rights to any data, content, posting, trademarks or logos that you have used through the Site or in connection with the Services.

If you provide suggestions or feedback to THE JOB about the Services, you agree that THE JOB can use and share such suggestions or feedback for any purpose without requiring any further consent, notice or compensation to you or any other persons. THE JOB reserves all of its intellectual property rights in the Services.

You recognize and acknowledge that all intellectual property rights associated with or contained in the Services and any other services rendered by THE JOB and used in the operation of the Services and any documents, data, or other related materials furnished by THE JOB in connection with or any data made available via the Site or the Services, including without limitation, all updates, upgrades, enhancements, new versions, improvements, developments, or new or other services or technology, belong solely to THE JOB or were duly licensed to THE JOB, and THE JOB is and shall remain sole owner of the same, and it is hereby expressly agreed that nothing in these Terms and Conditions shall constitute or be considered as constituting a transfer or license of any of such intellectual property rights or any part thereof to you or any third party. Neither you nor THE JOB will gain by virtue of these Terms and Conditions of Services, the Privacy Policy and Terms and Conditions of Use any rights of ownership of trademarks and any other intellectual property rights owned by the other.


7. DISCLAIMER OF WARRANTIES

To the fullest extent permissible and subject to applicable law, THE JOB disclaims all warranties, explicit or implicit, including but not limited to:

  • (a) all implied warranties and representations of satisfactory quality, merchantability, fitness of the Services for a particular purpose;
  • (b) accuracy or reliability of any data or content contained in the Site (all data and content contained in the Site is provided “as-is” and “as available” basis);
  • (c) efficiency of the function of the Services which will be uninterrupted or error-free; and
  • (d) the Services is free of any virus or other damaging components.

8. LIMIT OF LIABILITY

TO THE FULLEST EXTENT PERMISSIBLE AND SUBJECT TO APPLICABLE LAW, NOTWITHSTANDING ANY OTHER PROVISION HEREIN AND REGARDLESS OF WHETHER THE CLAIM OR FORM OF ACTION IS IN CONTRACT, TORT OR ANY OTHER FORM OF ACTION WHATSOEVER, INCLUDING, WITHOUT LIMITATION, NEGLIGENCE OF THE JOB OR ITS AFFILIATES, IN NO EVENT WHATSOEVER SHALL THE JOB BE LIABLE FOR ANY INDIRECT, PUNITIVE OR CONSEQUENTIAL LOSSES OR DAMAGES OR FOR ANY LOSS OF DATA, OPPORTUNITIES, REVENUE OR PROFIT, SUFFERED OR INCURRED BY YOU ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE SERVICES OR THESE TERMS AND CONDITIONS OF SERVICES.

NOTWITHSTANDING ANY OTHER PROVISION HEREIN AND REGARDLESS OF WHETHER THE CLAIM OR FORM OF ACTION IS IN CONTRACT, TORT OR ANY OTHER FORM OF ACTION WHATSOEVER, INCLUDING, WITHOUT LIMITATION, NEGLIGENCE OF THE JOB, IN NO EVENT WHATSOEVER SHALL THE JOB'S AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THE SERVICES HEREIN EXCEED:

  • (a) FIVE TIMES THE TOTAL FEES PAID OR PAYABLE TO THE JOB DURING THE ONE MONTH PERIOD BEFORE AN INCIDENT OCCURS (IF ANY), OR
  • (b) USD $150.00 .

WHICHEVER IS THE LOWER AMOUNT.


9. INDEMNITY

You agree to defend, indemnify and hold harmless THE JOB, its affiliates and each of their directors, officers, agents, contractors, partners and employees from and against any damages, losses, claim, liability, costs and expenses, including but not limited to, reasonable attorneys' fees,resulting from or in connection with your use of the Services or the Site, or any breach of your obligations or of any terms herein (including but not limited to any representation or warranty) or of any laws or rights of any third party.


10. CHANGE OF TERMS AND CONDITIONS OF SERVICES

THE JOB, in its absolute and sole discretion, reserves the right to change, vary, modify or update these Terms and Conditions of Services whether in whole or any part thereof, from time to time without prior notice to you. As such, you understand and acknowledge that you shall review these Terms and Conditions of Services on a regular basis. For any material changes, such changes shall be informed to you through the Services, THE JOB Services, the Site or any other available channels determined by THE JOB. If you do not agree to the changes, you may terminate your account and cease to use the Services. By continuing to use the Services or the Site after such changes are effective signifies that you accept and agree to the changes.


11. MISCELLANEOUS

  • (a) Any and all capitalized terms used herein shall have the meanings ascribed to such terms in the Terms and Conditions of Use, unless otherwise defined herein.
  • (b) Unless otherwise specified herein, all other terms and conditions of the Terms and Conditions of Use shall remain unchanged and be incorporated by reference into these Terms and Conditions of Services and shall apply as if fully set forth herein mutatis mutandis. In the event of a conflict between any provisions of the Terms and Conditions of Use and any provisions of theTerms and Conditions of Services, theTerms and Conditions of Services shall prevail.
